1. Acceptance and eligibility
By accessing or using an Everitt Ventures website, account, software product, application, API, integration, subscription, report, digital product, or professional service, you agree to these Terms, the applicable Privacy Policy, the EULA where software is involved, and any product-specific disclosures or order terms.
You must be at least 18 years old or the legal age of majority where you live, be legally able to enter a contract, and provide accurate information. If you use a service for an organization, you represent that you are authorized to bind that organization.
2. Services
Everitt Ventures may provide websites, software, web applications, mobile applications, desktop software, APIs, integrations, subscriptions, operational tools, artificial-intelligence features, digital products, automated reports, and professional services. Products may include EverittOS and future Everitt Ventures offerings.
Some services may include reports such as Website Health, Property Security, Home Security, Rental Readiness, Vacation Rental Readiness, Business Readiness, Feng Shui, or similar informational products. Features, availability, limits, and pricing may differ by product or plan.
3. Accounts and authorized users
You are responsible for maintaining accurate account information, safeguarding credentials, controlling authorized users, assigning appropriate permissions, and activity performed through your account unless applicable law provides otherwise.
Workspace owners and administrators are responsible for determining which employees, workers, contractors, customers, or other users may access business information and for removing access when it is no longer appropriate.
4. Customer information, content, and authorization
You are responsible for ensuring that information, files, photos, records, prompts, websites, properties, accounts, and other content you submit are accurate, lawful, and authorized. You must have all rights and permissions needed to collect, upload, process, share, or connect that information.
You may submit a website, property, business, system, or third-party account only when you own it, manage it, have permission to assess or connect it, or are otherwise legally authorized to do so.
Everitt Ventures may reject, remove, suspend, or refuse content, access, or an order that appears unauthorized, abusive, unsafe, illegal, misleading, fraudulent, infringing, or technically unsuitable.
5. Acceptable use
You may not use the services to:
- violate law, privacy, intellectual-property, employment, consumer-protection, export, sanctions, or contractual obligations;
- harass, discriminate against, defraud, impersonate, unlawfully monitor, or harm another person;
- perform unauthorized security testing, evade controls, deploy malicious code, overload systems, or interfere with availability;
- bypass payment controls, usage limits, account restrictions, or security measures;
- misrepresent automated output, software output, or a report as a professional certification, legal opinion, accounting opinion, inspection, appraisal, or regulated advice;
- resell, sublicense, scrape, reverse engineer, or commercially exploit protected services except where expressly permitted.
6. Payments, subscriptions, and renewals
Prices, billing intervals, usage limits, and included features are shown before purchase or in applicable order documentation. Payments may be processed by Stripe, Apple, Google, Intuit, or another disclosed provider.
Subscriptions may renew automatically until canceled through the applicable account settings or billing provider. Cancellation generally stops future renewal charges but does not retroactively refund prior billing periods except where required by law or expressly stated.
Taxes, currency conversion, marketplace charges, and provider fees may apply depending on location and payment method.
7. Refunds
Customized reports, digital products, completed services, and usage already consumed are generally non-refundable once processing or delivery begins, except where required by law. Subscription charges are generally non-refundable for a partially used billing period unless required by law or expressly offered.
If Everitt Ventures cannot deliver a purchased service because of an error within its control, it may retry, correct, replace, credit, partially refund, or fully refund the purchase as appropriate. Duplicate charges and verified billing errors will be corrected.
Refund and billing requests may be submitted through Support. Nothing in these Terms limits a cancellation, refund, or consumer right that cannot legally be excluded.
8. Third-party services and integrations
The services may connect with or depend on providers such as Stripe, Supabase, Netlify, Vercel, Google, Intuit, Apple, Microsoft, GitHub, email providers, analytics providers, storage providers, certificate authorities, hosting companies, and other platforms.
Third-party services are governed by their own terms, policies, permissions, security, availability, and technical limits. Everitt Ventures does not control and is not responsible for their downtime, discontinued APIs, policy changes, data accuracy, account restrictions, rate limits, or security incidents.
When you connect an integration, you authorize Everitt Ventures to access, receive, use, transmit, and store information within the permissions you approve as needed to provide that integration.
9. Software license
Software use is also governed by the End User License Agreement. Software is licensed, not sold. If these Terms conflict with the EULA regarding the software license, the EULA controls for that issue.
10. User content and business data
You retain ownership of content and business data you submit, subject to rights held by others. You grant Everitt Ventures a limited license to host, process, reproduce, transmit, display, and otherwise use that content only as reasonably necessary to provide, secure, support, improve, and operate the services, comply with law, and enforce agreements.
You are responsible for maintaining appropriate source records and backups and for exporting information you need before closing an account or ending a service.
11. Automated and artificial-intelligence features
Some services may use automation, rules, machine learning, or third-party artificial-intelligence providers to generate drafts, classifications, summaries, recommendations, forecasts, reports, or other output.
Automated output may be incomplete, inaccurate, outdated, biased, or inappropriate for a particular situation. You are responsible for reviewing output before relying on it or sharing it. Automated output is not legal, medical, tax, accounting, employment, insurance, investment, financial, engineering, security, or other regulated professional advice.
12. Reports and informational products
Automated and customized reports are generally point-in-time informational products based on customer-provided information, public information where applicable, automated rules, and general educational guidance. They are not inspections, appraisals, audits, certifications, guarantees, or substitutes for qualified professionals.

13. Website Health and security reports
Website Health and security reports use non-destructive checks of publicly observable signals unless a separate written agreement expressly provides otherwise. They are not penetration tests, complete vulnerability assessments, source-code reviews, authenticated security audits, malware-removal services, continuous monitoring, or certifications of security or regulatory compliance.
Results may contain false positives, false negatives, incomplete observations, or inconclusive results. Hosting, DNS, caching, firewalls, bot protection, temporary outages, geographic routing, third-party services, and later website changes may affect findings.
14. Property, home, rental, and readiness reports
These reports are based primarily on questionnaire answers and general readiness or risk-reduction practices. They are not physical inspections, engineering reports, code inspections, environmental assessments, insurance inspections, crime-risk guarantees, habitability determinations, or legal-compliance reviews.
Customers remain responsible for physical verification, maintenance, repairs, permits, local codes, landlord-tenant requirements, platform rules, insurance requirements, and consultation with qualified contractors or licensed professionals.
15. Feng Shui and lifestyle content
Feng Shui and similar lifestyle content is provided for cultural, reflective, lifestyle, or entertainment purposes. It is subjective and does not guarantee health, wealth, relationships, safety, business performance, or any other result. It is not medical, mental-health, architectural, engineering, religious, financial, or professional advice.
16. Customer responsibility
You remain responsible for evaluating recommendations, verifying information, maintaining backups and security controls, testing changes, selecting qualified professionals, obtaining permissions, complying with laws and contracts, and deciding whether and how to act on any output.
You should not make emergency, safety-critical, structural, medical, legal, financial, employment, accounting, or security decisions solely from automated output or a report.
17. Intellectual property
Everitt Ventures and its licensors retain all rights in software, APIs, documentation, methodology, templates, designs, interfaces, branding, trademarks, scoring methods, workflows, code, report structure, and other protected materials, excluding user content and third-party materials.
You may not remove attribution, claim authorship, copy protected elements beyond permitted use, reverse engineer protected software except where law permits, or use Everitt Ventures material deceptively.
18. Service changes, beta features, and availability
Features may be updated, replaced, limited, suspended, or discontinued. Beta, preview, experimental, or early-access features may be incomplete, unstable, changed without notice, or removed.
Everitt Ventures does not guarantee uninterrupted availability, compatibility with every browser, device, operating system, provider, integration, or business workflow, or preservation of every feature indefinitely.
19. Privacy and security
Personal information is handled as described in the Privacy Policy. Everitt Ventures uses reasonable safeguards, but no website, software system, transmission, authentication method, integration, or storage provider can be guaranteed completely secure.
You are responsible for credentials, devices, account permissions, backups, authorized-user access, and compliance obligations that apply to information you control.
20. Disclaimer of warranties
To the maximum extent permitted by law, the services are provided "as is" and "as available." Everitt Ventures disclaims implied warranties where legally permitted, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, compatibility, and accuracy.
No favorable score, recommendation, report, synchronization result, or absence of an alert guarantees that a website, system, property, business, account, or other subject is secure, safe, compliant, profitable, suitable, or problem-free.
21. Limitation of liability
To the maximum extent permitted by law, Everitt Ventures is not liable for indirect, consequential, incidental, special, exemplary, or punitive damages; lost profits, revenue, data, customers, opportunities, rent, bookings, goodwill, or business interruption; third-party failures; remediation or repair costs; synchronization errors; security incidents; property loss; or reliance on software output, reports, findings, priorities, or scoring.
To the maximum extent permitted by law, Everitt Ventures' aggregate liability arising from a specific paid service is limited to the amount paid for that service during the twelve months before the event giving rise to the claim, or one hundred U.S. dollars if no amount was paid, unless applicable law requires a greater amount.
These limitations do not exclude liability that cannot lawfully be excluded, including certain liabilities for fraud, willful misconduct, gross negligence, death, personal injury, or mandatory consumer rights.
22. Indemnification
To the extent permitted by law, you agree to defend and indemnify Everitt Ventures from third-party claims, losses, or expenses arising from your unlawful use, lack of authorization, infringement by your content, material breach of these Terms, misuse of third-party data, or deceptive use of a report or service. This obligation does not apply to the extent a claim was caused by Everitt Ventures' own unlawful conduct.
23. Suspension and termination
Everitt Ventures may suspend, limit, terminate, or decline service for unlawful activity, unauthorized submissions, fraud, abuse, security threats, nonpayment, repeated chargeback abuse, material breach, excessive harmful use, or inability to safely provide a service.
Where supported, you should export needed information before termination or account deletion. Certain provisions concerning ownership, payment obligations, disclaimers, liability, disputes, and other provisions that by their nature should survive will remain effective.
24. Export controls and sanctions
You may not use, export, re-export, or provide services in violation of applicable export-control, sanctions, or trade laws. You represent that you are not prohibited from receiving the services under applicable law.
25. Changes to these Terms
Everitt Ventures may update these Terms to reflect legal, technical, security, platform, product, or operational changes. The updated date will appear above. Material changes may be communicated through the applicable website, application, account notice, or email where required.
26. Governing law and disputes
These Terms are governed by the laws applicable to Everitt Ventures' operating location, without overriding mandatory consumer protections that apply where a user resides. Venue, dispute procedures, arbitration, and class-action terms are not imposed by this operational draft and should be finalized with qualified counsel.
